Nov. 18, 2015 - Lee H. Ayres and Stacey A. Smith Prevailed at Trial in Significant Right of Way Litigation
Lee H. Ayres and Stacey A. Smith represented a mid-stream company, which purchased a right of way for one of its pipelines. The client purchased the right of way from the property owner as shown by the public records. Despite having purchased the right of way from the title owner of record, a neighboring property owner filed suit, asserting that he had acquired ownership of that property by process of thirty year adverse possession. The case proceeded to trial with several witnesses testifying on both sides regarding facts ranging from the early 1960's through 2012. The trial court ruled in favor of our client, finding that even if the plaintiff's (adjacent land owner) had taken ownership of the property in question by thirty year adverse possession , he subsequently lost ownership by more than 10 years of possession by the current record title owner. At the conclusion of the trial, the court rendered judgment in favor of the client dismissing all the plaintiff's claims with prejudice at plaintiff's cost.
